who is an officer under the WHS act?
a person who makes, or participates in making, decisions that affect the whole or a substantial part of an organisation: directors, company secretaries and senior executives. it's about influence over the organisation, not job titles.
what does officer due diligence actually require?
the WHS act sets out six elements: keep WHS knowledge current, understand the operations and their hazards, ensure resources and processes exist to manage risk, ensure incident information is received and acted on, ensure legal compliance processes exist, and verify that all of this is actually happening.
can due diligence be delegated?
no. officers can be supported by advisers and reporting, but the duty is personal and can't be discharged by relying on others. that's why this course focuses on the questions officers should ask and the verification they should seek themselves.
